Welcome to 16x.ai (the “Service”, “we”, “us”, or “our”). 16x.ai is operated by 云通四海有限公司 and is an enterprise-grade, omni-channel AI customer-engagement and operations platform providing outbound/inbound calling, instant-messaging (IM) integration, real-time translation, AI reception, and lead operations.
Before registering, signing in, or using the Service, please read and fully understand these Terms of Service (the “Terms”). By checking the consent box, completing registration, or otherwise using the Service, you (“you”, “your”, or “User”) acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.
If you use the Service on behalf of a company or organization, you represent that you are authorized to bind that entity, and these Terms apply to it as well.
1. The Service
The Service provides one or more of the following features (subject to the plan you activate and the product pages):
- Omni-channel engagement: unified handling across website widgets, mini-programs, app SDKs, phone numbers, and major IM channels;
- AI voice and text reception, real-time speech translation, call transcription and summarization;
- Lead and contact management, call analytics, and automated follow-up and operations;
- Dashboards, team collaboration, and related value-added services.
We may adjust, upgrade, or optimize the Service as needed and will announce material changes through appropriate means.
2. Account Registration and Security
You may register or sign in via phone number, email, or third-party accounts (such as Google or WeChat). You must provide information that is true, accurate, complete, lawful, and current, and keep it updated.
You are responsible for safeguarding your account and credentials and for all activity under your account. Notify us immediately of any unauthorized use.
We are not liable for losses arising from your failure to protect, or your voluntary disclosure of, your credentials.
3. Acceptable Use
You agree to comply with all applicable laws and not to use the Service to:
- Make harassing calls, send spam, or conduct marketing without the recipient’s consent;
- Engage in fraud, pyramid schemes, gambling, pornography, or other unlawful activity;
- Upload or distribute illegal, infringing, false, or otherwise objectionable content;
- Collect, use, or trade personal information of others without lawful authorization;
- Infringe intellectual property, trade secrets, or other rights;
- Attack, interfere with, or disrupt the Service, or circumvent billing or quota limits;
- Otherwise violate applicable law or these Terms.
You are solely responsible for the legality of all calls, messages, and content initiated through the Service, and you must obtain all necessary consents (including for call recording, message logging, and personal-information processing).
4. Third-Party Services and Channels
Certain features rely on third-party providers, including telecom carriers and number providers, IM platforms, payment institutions, AI model providers, and cloud service providers.
Your use of those channels is also subject to the relevant third party’s terms and rules. We will use reasonable efforts to assist with issues caused by third-party services but are not responsible for them.
5. Fees, Credits, and Payment
The Service combines subscription plans with usage-based billing (credits). Pricing is as published on the product pages.
New users may receive complimentary trial credits, which offset resource consumption (calls, translation, AI processing). Unless required by law or otherwise stated, complimentary credits are non-refundable and non-transferable.
You must pay applicable fees in full and on time. If your balance or credits are insufficient, features may be limited or suspended. Except as required by applicable law or our refund policy, consumed fees are non-refundable.
6. Intellectual Property
Except for User Content, all intellectual property in the Service—including software, interfaces, trademarks, text, graphics, and models—belongs to 云通四海有限公司 or its licensors and is protected by law.
Subject to your compliance with these Terms, we grant you a limited, revocable, non-transferable, non-exclusive license to use the Service for your lawful business purposes only. You may not copy, modify, lease, sell, reverse-engineer, or otherwise exploit the Service without written permission.
7. User Content and Data
“User Content” means data you upload, generate, or process while using the Service, including contacts, call recordings and transcripts, message logs, and knowledge-base materials. You are responsible for its legality and warrant that you hold the necessary rights or authorizations.
To provide and improve the Service (e.g., transcription, translation, summarization, quality assurance, and model inference), we and our providers will process User Content as necessary. We protect such data in accordance with our Privacy Policy.
You may export or delete your User Content during the term. After termination, we will process or delete data in accordance with applicable law and our Privacy Policy.
8. Changes, Interruption, and Termination
We may suspend or interrupt all or part of the Service due to maintenance, upgrades, failures, force majeure, or legal requirements, using reasonable efforts to provide advance notice.
If you violate these Terms or applicable law, we may warn you, restrict features, or suspend or terminate the Service, without liability.
You may stop using the Service and request account deletion at any time. Data will be handled per our Privacy Policy.
9. Disclaimers and Limitation of Liability
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we make no express or implied warranty that the Service will be uninterrupted, error-free, or fit for your particular purpose.
AI-generated content (such as summaries, translations, and suggestions) may be inaccurate, is for reference only, and does not constitute professional advice; you are responsible for verifying it and for decisions based on it.
To the maximum extent permitted by law, we are not liable for indirect, incidental, punitive, or consequential damages, and our aggregate liability is limited to the fees you actually paid for the Service in the twelve (12) months preceding the claim.
10. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which 云通四海有限公司 is established, excluding conflict-of-laws rules.
The parties will first seek to resolve disputes amicably. Failing that, either party may bring the dispute before the competent court at the place where 云通四海有限公司 is established.
11. Changes to These Terms
We may revise these Terms from time to time. Updated Terms will be posted on this page, and material changes will be notified by appropriate means.
Your continued use after an update constitutes acceptance of the revised Terms. If you disagree, you must stop using the Service.
